DOJ called upon to investigate the Shenadoah racist killing





The A.P. is reporting that two teens acquitted of the most serious state charges in the beating death of a Mexican immigrant could face federal charges.The Justice Department's Civil Rights Division is reviewing evidence surrounding the fatal fight last summer between high school football players and Luis Ramirez in predominantly white Schuylkill County, spokesman Alejandro Miyar said yesterday.

Brandon Piekarsky, 17,and Derrick Donchak, 19,were acquitted of third-degree murder and ethnic intimidation by an all-White jury. The problem is the Shenandoah is over 95% White with many of its residents apparently espousing anti-immigrant hatred.

The problems with this case start on the night of the racist killing. Eileen Burke, a retired Philadelphia police officer, states that the first police officer on the scene saw the badly beaten and dying Ramirez and asked him if he was drunk. Burke also stated that the officer acted in a manner which suggested to her that the officer wanted to kick Ramirez as he lay dying on the ground. She furthered criticized the police for not securing the crime scene. The police did not even use yellow tape to keep the people out.

The day after the killing, a police officer who was the partner of the live-in boyfriend of the mother of the teen accused of murder was the first cop to speak to the young men. There are implications that he told them to work on coordinating their stories. Rather than investigate and gather evidence, the local law agency was obstructing justice by telling the killer teens to get their stories straight.

Eileen Burke was never called as a witness by the incompetent prosecutor. She would have been a credible witness as a former cop. She also offered her opinion as to her surprise that the all-White jury did not convict the teen killers of ethnic intimidation. According to published reports she said: "How did the ethnic intimidation go? Because the first thing that got me out of my room was the "f" word the "Spic" word, you know what I mean?"

The prosecutor did not adequately challenge the defense attorney when he called Tovar Alvarez to the stand. Alvarez, a friend of Ramirez, arrived AFTER the fatal beating. His presence had nothing to do with the fact that Ramirez was fatally beaten by the teens.

Alvarez showed the teens a BB gun as they were fleeing AFTER the beating. The defense attorney presented the gun to the jury. This seemed to ignite the jury according to several who attended the trial.

Alvarez and the BB gun had nothing to do with the beating. This was after the fact.

Now, the jury foreman is stating that he observed prejudice in fellow jurors.

Injustice for one is injustice for all.

    CNN analyst calls for federal hate crimes investigation

    Brandon Piekarsky and Derrick Donchak were acquitted of various state charges resulting from the beating and murder of Luis Ramirez. CNN legal analyst Jeffery Toobin is calling for a federal hate crimes investigation. The facts and circumstances of this case certainly call for at least a federal investigation because it is possible when a group of individuals are acquitted on state charges, that federal bias charges can be brought, explained Toobin.

    Thank you for the videos that you find and offer on your site.

    As to Fox News I call them Fox Spews or Faux News. I had a mostly civil conversation with a group of protesting minutemen last week. They argued that the only true news is coming from the Fox network. It was at that point that I civilly said good-bye and crossed the street to join the May Day marches.

  4. I wrote to Brandon and Derrick via myspace. Derrick ignored me but Brandon replied three times. He advised me not to listen to the newspapers because they only want to make money. He also told me to get the facts straight.

    I asked him if he has any remorse and he replied that I just don't get it and that he will not reply anymore.

    He was not concerned about a possible federal investigation. Apparently he is confident that it will play out like it did in county court.

  6. Jeff Sessions grew up in a South that was in the last stages of apartheid. Many of these older folks have held on to their prejudices. Introspection of one's personal biases is a difficult process and many never travel down that road. Obviously, Jeff Sessions has not ventured down that road less traveled.

    I found his myspace address on a youtube video. Brandon responded to my message several of my messages to him. He admitted what happened was a "tragedy" but,in my opinion, he still is in a denial as to his responsibility for the death of Luis Ramirez. I appreciated his honesty and candor.

    He factually states that "not guilty is not guilty" and he is correct. Our judicial system played out and he was found not guilty. But it is not as simple as that.

    Someone died that night. Someone kicked a defenseless man while he lie on the street. Most likely that kick killed Ramirez. That person will be haunted by night. Or that person will become cold and dysfunctional as a way to deal with what he did.

    I know that there are emotions that he (Brandon) is not dealing with and I hope that someday soon he is able to talk about it with a therapist. It will be a needless shame if he builds self-defense mechanisms that make him cold enough to live with this tragedy. It will affect every type of relationship he is in.

    Too often I find that I forget who I am (a social worker)when I write my blog.

    I will e-mail you his address within the hour. I need to run to do my turn in picking up kids from school.
